The fee schedule was developed on behalf of
the Montana Employment Relations Division through a
contract with Ingenix, Inc. Because the fee schedule includes data that is
proprietary to Ingenix, certain restrictions apply. These restrictions are set
out below.

ACKNOWLEDGES YOUR ACCEPTANCE OF THE TERMS BELOW, WHICH APPLY TO ALL OF THE
MATERIALS CONTAINED HEREIN. You are referred to below as “User.”
LICENSE & RESTRICTIONS. Ingenix grants to User a nonexclusive,
nontransferable license to use the Ingenix data contained on this site (“the
Data”) only for purposes of determining the appropriate fee to charge or pay
for health care services provided pursuant to the Montana workers’
compensation system. User may not sublicense, assign, or transfer the license
or the Data to any third party. User may NOT use the Data on any public
computer based medical information system, or publish, translate, decompile,
disassemble, or create any derivative work based on the Data.
User understands that the Data are intended to be a fee schedule and not a
stated or implied “reasonable and customary” charge. The Data is provided
as-is. INGENIX PROVIDES THE DATA WITHOUT WARRANTY OF ANY KIND, AND DISCLAIMS
ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE
IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
DATA PROTECTION. United States and international copyright laws protect
this Data, accompanying documentation and file contents. User acknowledges that
the Data and the process and technologies included therein are valuable assets,
trade secrets, and/or copyrighted material of Ingenix and that Ingenix retains
title to the Data.
CPT codes and two-digit modifiers maintained in the Data are Copyright
2006 (or other such date of publication of CPT as defined by US copyright
laws) the American Medical Association.
U.S. GOVERNMENT RIGHTS. The Data include CPT which is commercial
technical data and/or computer databases and/or commercial computer software
and/or commercial computer software documentation, as applicable which were
developed exclusively at private expense by the American Medical Association,
515 N. State Street Chicago IL 60610. U.S. Government rights to use, modify,
reproduce, release, perform, display, or disclose these technical data and/or
computer databases and/or commercial computer software and/or commercial
computer software documentation are subject to the limited rights restrictions
of DFARS 252.227-7015(b)(3) (June 1995) and/or subject to the restrictions of
DFARS 227.7202-1(a) (June 1995) and DFARS 227.7202-3(a) (June 1995), as
applicable for U.S. Department of Defense procurements and the limited rights
restrictions of FAR 52.227-14 (June 1987) and/or subject to the restricted
